1. About These Terms

These Terms of Service ("Terms") govern your use of Quizmeter, an online live quiz hosting platform operated by QuizMeter, an individual freelancer based in New Delhi, India ("we", "us", "our"). By accessing or using quizmeter.app, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use Quizmeter.

2. Definitions

• Host: A registered user who creates quizzes, starts sessions, and manages participants.
• Participant: A person who joins a quiz session using a room code. No account required.
• Session: A single live quiz event created and run by a Host.
• Platform: The Quizmeter website (quizmeter.app) and all associated services.

3. Eligibility

To create a Host account, you must be at least 18 years old. By registering, you confirm that you meet this requirement. Participants (quiz joiners) may be of any age: it is the Host's responsibility to ensure appropriate use of the platform for their audience, including obtaining any necessary parental consent.

4. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and truthful information when registering.
• You may not share your account with others or use another person's account.
• You must notify us immediately at hello@quizmeter.app if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree not to use Quizmeter to:

• Host content that is unlawful, defamatory, obscene, hateful, or violates any third-party rights
• Conduct any form of cheating, fraud, or deceptive practice
• Attempt to gain unauthorised access to any part of the platform or other users' data
• Use automated scripts, bots, or scrapers without our written consent
• Impersonate any person or entity
• Violate any applicable Indian or international law or regulation
• Engage in any activity that disrupts the platform's normal functioning

We reserve the right to remove content and/or suspend accounts that we determine, in our sole discretion, violate these rules.

6. Quiz Content

You retain ownership of all quiz content you create. By uploading content to Quizmeter, you grant us a non-exclusive, royalty-free, worldwide licence to store, display, and transmit that content solely as necessary to provide the platform services. We do not claim ownership of your content and will not use it for any other purpose.

You are solely responsible for ensuring that your quiz content does not infringe any copyright, trademark, or other intellectual property rights, and that it complies with all applicable laws.

All payments are final and non-refundable. We do not offer refunds for any subscription fees once payment has been processed, including in cases of partial-month usage, plan downgrades, or account cancellation.

If a payment fails or is duplicated due to a technical error on our part, please contact us at hello@quizmeter.app and we will investigate and resolve the issue on a case-by-case basis.

9. Cancellation

You may cancel your paid subscription at any time from your Billing page. Cancellation takes effect at the end of your current billing period: you retain full access to your paid plan until then. After the billing period ends, your account reverts to the Free plan.

You may delete your account at any time by contacting us at hello@quizmeter.app. Account deletion is permanent and cannot be undone.

10. Service Availability

We aim to maintain high availability of the Quizmeter platform but do not guarantee uninterrupted service. We may carry out maintenance, updates, or emergency fixes at any time. We are not liable for any loss or inconvenience caused by temporary unavailability of the service.

11. Intellectual Property

The Quizmeter name, logo, website design, and all platform software are the intellectual property of the operator. You may not copy, reproduce, modify, or distribute any part of the platform without our prior written consent.

12. Limitation of Liability

To the maximum extent permitted under applicable Indian law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of Quizmeter: including loss of data, loss of revenue, or interruption of business.

Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount you paid us in the three months preceding the claim.

13. Disclaimers

Quizmeter is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not warrant that the platform will be error-free, that defects will be corrected, or that the platform is free of viruses or other harmful components.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Before initiating legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at hello@quizmeter.app.

15. Changes to These Terms

We may update these Terms from time to time. We will notify registered Hosts by email at least 7 days before any material change takes effect. The "Last updated" date at the top of this page will always reflect the most recent version. Continued use of Quizmeter after the effective date constitutes your acceptance of the revised Terms.
